These Terms of Service apply when you access Occult Print Shop, place an order, upload artwork or use our products and services.

References to “we”, “us” and “our” mean Occult Print Shop LTD.

These Terms should be read alongside our Privacy Policy, Shipping Policy, Return & Refund Policy and, where applicable, our Purchase Options Cancellation Policy.

Nothing in these Terms limits your statutory consumer rights.

2. Using Our Website

By using our website or placing an order, you confirm that:

• the information you provide is accurate and complete;

• you will not use our website or services for unlawful or fraudulent purposes; and

• where required, you have the authority or permission necessary to enter into the transaction.

We may restrict access to our services where we reasonably suspect fraud, abuse, unlawful activity or a serious breach of these Terms.

3. Orders

Submitting an order does not necessarily mean we have accepted it.

We may refuse or cancel an order where reasonably necessary, including where:

a product is unavailable;

there is an obvious pricing or listing error;

payment cannot be authorised;

required artwork or information has not been supplied;

an order appears fraudulent;

fulfilling the order would be unlawful; or

supplied content breaches these Terms.

If we cancel an order after payment has been taken and no amount is properly due, we will refund the relevant payment to the original payment method.

4. Custom, Personalised & Made-to-Order Products

Many of our products are printed or produced after an order is placed.

Some products are also genuinely personalised or made to a customer's individual specification.

Different cancellation rights may apply to genuinely personalised or bespoke products. Details are provided in our Return & Refund Policy.

The fact that a standard product is manufactured or printed after ordering does not by itself mean that it is treated as a personalised product.

5. Customer Artwork & Uploads

You remain the owner of artwork and files you supply to us unless otherwise agreed in writing.

By submitting artwork, designs, logos, photographs, text or other material, you confirm that you own the relevant rights or have permission to use and reproduce that material.

You grant us a limited licence to use, reproduce, process and modify the supplied material only as reasonably necessary to provide the products or services you have requested, including preparing files for production and fulfilment.

You must not knowingly submit material that:

infringes copyright, trade marks or other intellectual property rights;

is unlawful;

contains illegal or exploitative material; or

would make its production or distribution unlawful.

We may refuse an order where we reasonably believe supplied content infringes third-party rights or applicable law.

6. Artwork Quality & Customer Instructions

Customers are responsible for checking the accuracy of information, wording, dimensions and other instructions they supply.

Where we provide a proof for approval, you are responsible for checking that proof carefully before approving production.

We are not responsible for errors contained in customer-supplied artwork or instructions that we have reproduced accurately.

This does not affect your rights where we have failed to produce the item in accordance with the agreed specification.

7. Colour, Print & Product Tolerances

We take reasonable care to represent products accurately.

However:

colours displayed on screens can vary between devices;

printed colour may differ slightly from a digital preview;

minor variations in cutting, positioning, finishing or colour can occur during normal print production; and

photographs and mockups may not reproduce exact scale or colour.

Normal production tolerances do not constitute a defect where the finished product remains consistent with the description and specification supplied.

8. Prices & Payment

Prices are displayed in the currency shown on the website.

Delivery charges, taxes and other applicable charges will be displayed or explained before purchase where required.

Prices may change for future purchases without notice. A price change does not alter the agreed price of an order that we have already accepted, except where there has been an obvious error and applicable law permits correction.

Payment must be successfully authorised in accordance with the payment terms shown at checkout.

9. Shipping & Delivery

We dispatch orders from the United Kingdom.

Delivery dates and carrier transit times shown on our website are estimates unless a service is expressly described as guaranteed.

International shipments may be delayed by customs, postal authorities, security checks, local delivery networks or other circumstances outside our direct control.

Although these events may be outside our direct control, this does not remove any responsibility or statutory rights we have as the seller.

Risk in goods remains with us until the goods are delivered into the physical possession of you, or a person you have identified to receive them, except where applicable law provides otherwise.

10. Customs & International Orders

International customers may be required to pay import duties, sales taxes, customs charges or local handling fees imposed by the destination country.

Unless expressly stated otherwise at checkout, these charges are not included in the price paid to us and are the responsibility of the recipient.

Customers are responsible for responding to legitimate requests from local customs or postal authorities where payment or additional information is required.

11. Returns, Refunds & Cancellations

Returns, cancellations, faulty goods and refunds are handled in accordance with our Return & Refund Policy.

Nothing in these Terms removes rights provided by applicable consumer law.

Products supplied to consumers must be as described, of satisfactory quality and fit for their intended purpose where applicable.

12. Subscriptions & Other Purchase Options

Certain products or services may be offered as subscriptions, pre-orders or other recurring purchase arrangements.

The price, frequency, renewal terms and available cancellation options will be shown before purchase.

13. Intellectual Property

Unless otherwise stated, the website, branding, original artwork, graphics, layouts, photography, written material and other content belonging to Occult Print Shop LTD are protected by applicable intellectual property law.

Third-party material remains the property of its respective owner.

Customer-supplied artwork remains subject to the rights described in Section 5.

Unauthorised commercial reproduction or exploitation of our protected content is prohibited except where permitted by law.

14. Prohibited Use

You must not use our website or services to:

commit fraud or other unlawful activity;

interfere with the security or operation of the website;

transmit malicious software;

unlawfully collect data about other users;

infringe intellectual property rights; or

order the production of material that would be unlawful for us to produce or supply.

15. Third-Party Services

Our website may use services provided by third parties, including payment providers, delivery carriers, Shopify applications, fulfilment partners and file-processing services.

Third-party services may occasionally experience outages or technical problems outside our direct control.

We will not be responsible for a third party's independent acts or failures where it would be unlawful or unreasonable to hold us responsible, but nothing in this section removes any responsibility we have to you under applicable consumer law.

16. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for:

death or personal injury caused by negligence;

fraud or fraudulent misrepresentation; or

statutory consumer rights that cannot legally be excluded.

Where permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was made or losses caused by circumstances for which we are not legally responsible.

If you purchase from us primarily for business purposes, additional limitations permitted by law may apply.

17. Privacy

We process personal information in accordance with our Privacy Policy and applicable data protection law, including the UK GDPR and Data Protection Act 2018 where applicable.

18. Website Availability

We aim to keep our website and online services available but cannot guarantee uninterrupted access.

Maintenance, security updates, technical problems or failures affecting third-party infrastructure may temporarily interrupt access.

19. Changes to These Terms

We may update these Terms from time to time, including where our services, business practices or legal requirements change.

The latest version will be displayed on this page together with its revision date.

Changes to these Terms will not retrospectively alter the terms that applied to an order already placed unless required by law or expressly agreed with you.

20. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, this does not deprive you of any mandatory protections available to you under the laws applicable in the country where you live.

Any dispute will be subject to the jurisdiction applicable under relevant law.
